By agreeing to join helloPay’s Loyalty Program, you will be agreeing to the following Terms and Conditions stated below.

I hereby apply to be a member of helloPay’s Loyalty Program and the information I provide to the helloPay Loyalty Program will namely enable helloPay to:

  • keep track of my purchase records and transactions;
  • allocate helloPay Loyalty Program points according to my purchase records or through marketing campaigns; and
  • update me periodically about helloPay’s sales program through which I may earn helloPay Loyalty Program points.

I also consent to:

  • helloPay’s collection and use of the data required by helloPay’s Loyalty Program application form;
  • the helloPay Loyalty Program terms and conditions set out below, and to helloPay’s data protection parameters set out below; and
  • helloPay sharing the same information within helloPay’s group of companies that are established in Southeast Asia, for the purposes stated above.

helloPay Loyalty Program

Terms and Conditions

I. The helloPay loyalty program is intended for use by users who register online in the Philippines only, and for exclusive use on the domains in the Philippines only. The helloPay loyalty program allows you to accumulate helloPay Loyalty Program points (“Points”), based on purchases you make at helloPay merchants or through marketing campaigns.

II. Points can be obtained from helloPay designated merchants in the Philippines. The merchants can be:

  • closed loop - the Points can be used only with one particular merchant;
  • semi-open loop - the Points can be used with a specified group of merchants; and
  • open loop - the Points can be used with any helloPay merchant within a certain region.

III. The value of the Loyalty Point is 1 (one) point earned = 1 (one) Philippine Peso that can be spent at a designated Philippines merchant.

IV. helloPay reserves the right to delete accumulated points from user accounts after an inactive period of 18 (eighteen) months without any prior notification to the user.

V. Your application will not be accepted for approval if the information provided is incomplete and/or illegible, thereby rendering it unusable.

VI. In case your helloPay account has been compromised, please approach the user support as soon as possible within operating hours via e-mail or Phone to report the issue.

VII. Subject to clause IX below, points entitle you to purchase products available for sale at the designated merchants, unless otherwise specified in the terms and conditions or marketing campaign. To qualify for the purchase using Points, you must have a positive helloPay point balance. There is no limit to the number of times you may use your Points in a day.

VIII. Points can be used by you as sole payment funds as well. Points accumulated by you cannot be transferred to any other helloPay User nor exchanged for cash.

IX. Points are personal and non-transferable.

X. You may check the Points accumulated by you by logging in into your helloPay account.

XI. helloPay reserves the right to modify the terms and conditions and/or suspend the helloPay Loyalty Program. In the event of such modification and/or suspension, helloPay will notify its users via email or SMS, as well as communicate this on our website. Users will not receive any compensation from helloPay in the event of modification or suspension of the helloPay Loyalty Program.

XII. Users who require helloPay to delete the user's data from helloPay’s database will forthwith lose any and all Points accumulated by the User in the database and/or linked to his/her helloPay Loyalty account. The data of the user will be deleted afterwards from the helloPay database.

XIII. helloPay reserves the right to:

  • permanently disable or suspend the helloPay Loyalty Program and/or Points, in the event of fraud or attempted fraud by the User and/or by the member's inappropriate use of the helloPay Loyalty Program, and
  • terminate the helloPay Loyalty Program for any reason whatsoever by informing Users via email/mail as well as on the helloPay website. In such an event, Users will be given a period of 30 (thirty) calendar days to use up his/her loyalty points, and upon the expiry of the said period of 30 (thirty) calendar days, any balance Points unused will be forfeited and invalidated.
  • In the case of a termination and/or suspension of the helloPay Loyalty Program, helloPay will NOT be liable to Users for unused Points.

XIV. helloPay shall not be liable for any system malfunction, system failure or disruption in accessing to the helloPay Loyalty Program, or any consequences, direct or indirect, arising from the same.

XV. helloPay shall not be liable or responsible for any fraud or unsuccessful transactions made using Points.

XVI. helloPay may at appropriate time and at its sole discretion revise these Terms & Conditions of use at any time by amending this page without giving its Users prior notice. Users are therefore advised to check this page from time to time to take notice of any changes helloPay has made. Users understand and agree that any use of the helloPay Loyalty Program after the date on which the Terms & Conditions have changed are subject to the amended Terms & Conditions.

helloPay Data Protection Parameters

I. helloPay collects data from and about its users who join the helloPay Loyalty Program solely for the following purposes:

  • to keep track of member's purchase records;
  • to allocate Points according to member's purchase records;
  • to update Users about helloPay’s sales programs (eg. promotions, news, brand offerings etc.) through which Users may earn Points;
  • to update our profiling of member's preferences so that helloPay may tailor its products and services to serve users better.

II. helloPay may from time to time, share such data collected with related companies within the helloPay group of companies only. In this context, helloPay may also transfer such data outside the territory of the Philippines, in accordance with the Data Privacy Act of 2012, for the purposes mentioned in clause I. above,to:

  • helloPay’s employees;
  • helloPay’s providers who need to have access to the Data in order to execute their obligations and deliver their services;
  • helloPay’s subsidiaries; and
  • the companies which belong to the helloPay Group and/or Lazada Group and other eligible merchants.

III. Users are responsible for the accuracy and completeness of any data submitted to helloPay and helloPay does not guarantee the accuracy of data collected by helloPay from its Users. Users who wish to scrutinize, amend or delete data relating to him or her, may do so by logging in to their helloPay accounts.

IV. helloPay will protect User data for whichever is the earlier of the following:

  • a period of 15 years after User's record is first created in helloPay’s database records; or
  • a period of 10 years after the death of a User.

V. helloPay shall be entitled to disclose User’s/Users' data to only the following:

  • helloPay’s solicitors for purposes of legal advice, settlement of dispute or litigation to protect helloPay’s interest;
  • helloPay’s affiliate or subcontractors that manage helloPay’s Loyalty Program;
  • Persons involved in collecting a debt owed by that User/member to helloPay;
  • Judicial, administrative and regulatory bodies who issue orders/subpoenas requiring the disclosure of user’s/users information, provided the information is relevant to the proceedings to which the disclosure of information pertaining to the user/s is required;
  • To a statistician for scholarly or research purposes; or
  • Where such disclosure is required by law.

VI. helloPay reserves the right to delete completely specific users/user’s' data from helloPay’s database in the event that the said Users' use of helloPay’s Loyalty Program is terminated and/or the said Users' Points are terminated for any reason whatsoever. helloPay reserves the right to delete all Users' data in its database in the event that the helloPay Loyalty Program is terminated for any reason whatsoever. The action of deletion is subject to the guidelines of information retention of helloPay as provided for under Clause IV above.

VII. Users have the right to request for the amendment or deletion of his/her data provided to helloPay.

Other Conditions

I. helloPay reserves the right to replace Points with any other reward of similar value as determined by helloPay.

II. helloPay shall be entitled to treat all instructions, whether oral, in writing or electronic, relating to Points or the use or redemption of Points, which are purportedly given to the helloPay by the User to whom the Points are awarded as the instructions of such User and to act in accordance with such instructions.

III. helloPay’s decision on all matters relating to or in connection with the helloPay Loyalty Program shall be final and binding on all Users.

IV. In the event of any inconsistency between these terms and any brochure, marketing or promotional material relating to the helloPay Loyalty Program, these Terms & Conditions shall prevail.

V. These Terms & Conditions shall be governed by and construed in accordance with the laws of the Philippines and all Users hereby submit to the exclusive jurisdiction of the courts of Makati City, to the exclusion of all other courts.

VI. helloPay shall not be liable if it is unable to perform its obligation under these Terms & Conditions, due directly or indirectly to Force Majeure, the failure of any computers, machines or communication systems, industrial disputes, wars, Act of God, those events which could not be foreseen, or which, though foreseen, are inevitable, or anything outside the control of helloPay or its servants and/or employees.
